BTerms & Conditions of Sale

Thank you for choosing 1800Guns.com, a solely owned subsidiary of Michael Williams and Metropolitan Luxury Homes. By registering, placing a bid, or making a purchase on 1800Guns.com, you acknowledge and agree to the following terms in full:


1. Returns, Exchanges, Refunds, and Restocking Fee

All sales conducted through 1800Guns.com are generally final due to the nature of auctions. However, 1800Guns.com strives to ensure buyer satisfaction and may, at its sole discretion, approve returns under the following conditions:

  • Return Window: All returns must be initiated within 25 days from the date of purchase.
  • Prior Approval Required: Buyers must obtain prior written approval from 1800Guns.com before returning any item. Unauthorized returns will not be accepted.
  • Restocking Fee: A 27% restocking fee of the final purchase price (including the buyerโ€™s premium) may apply for approved returns.
  • Condition of Returned Items: Items must be returned in the same condition as received, including all packaging, documentation, and accessories. Items showing damage or use may be subject to additional fees or denial of the return.
  • Refund Method: Approved returns will be refunded via the original payment method, minus any applicable restocking fees. This refund constitutes the buyerโ€™s sole and exclusive remedy.
  • Exceptions: 1800Guns.com reserves the right to deny any return or modify the terms of a return at its sole discretion. All decisions are final and binding.

2. Buyerโ€™s Responsibility

It is the sole responsibility of the buyer to know, understand, and comply with all federal, state, and local laws regarding the purchase, transfer, and possession of any item listed on 1800Guns.com โ€” including, but not limited to, firearms, ammunition, accessories, or other restricted items.

All restricted items must be transferred to a licensed Federal Firearms License (FFL) dealer located within the buyerโ€™s state of residence for final distribution. The buyer must provide a valid copy of their receiving FFLโ€™s license and ensure compliance with all applicable laws.

If a buyer is unable to complete a transaction because they are not legally permitted to purchase or possess an item, or because they fail to meet any legal or logistical requirement, no refund or credit will be issued, unless 1800Guns.com chooses to do so at its sole discretion.

It is the buyerโ€™s duty to ensure that they are legally eligible to purchase before bidding or buying.


3. Compliance With U.S. and International Law on Cultural Property and Antiquities

Section 1. Preamble: Commitment to Ethical Practice

1800Guns.com, operating under Michael Williams and Metropolitan Luxury Homes (hereinafter โ€œthe Auction Houseโ€), is committed to the ethical and lawful trade of fine art, antiques, collectibles, and other valuable property. We operate in full compliance with all international, federal, and state laws governing the sale and transfer of cultural property.

Section 2. Due Diligence and Provenance

  • The Auction House exercises due diligence to investigate the provenance and legal standing of all lots offered for sale. However, due to the nature of certain objects, a complete and uninterrupted provenance cannot always be guaranteed.
  • All statements by the Auction House regarding authorship, attribution, origin, date, age, provenance, and condition are opinions only, not statements of fact. All lots are sold โ€œAS IS.โ€

Section 3. Compliance with International and Domestic Agencies

As part of our due diligence, the Auction House proactively checks relevant lots against national and international databases of stolen or illegally exported property, including but not limited to:

  • INTERPOL Stolen Works of Art Database
  • The Art Loss Register (ALR)
  • UNESCO 1970 Convention
  • FBI National Stolen Art File (NSAF)
  • ICE Homeland Security Investigations (HSI) Cultural Property Program
  • U.S. Department of State: Cultural Property Implementation Act (CPIA)
  • IFAR Catalogues and ICOM Red Lists

This list is not exhaustive. The Auction Houseโ€™s compliance extends to any recognized law enforcement or cultural heritage protection body.

Section 4. Consequences of a Claim

If, at any time, a lot is credibly claimed to be stolen, looted, or illegally exported and that claim is recognized by a monitoring agency:

  • The Auction House may withdraw or cancel the sale.
  • The Auction House will cooperate fully with authorities to facilitate restitution.
  • The successful bidder agrees to relinquish any claim to the lot upon notification.
  • The buyerโ€™s sole remedy will be a full refund of the final purchase price, including buyerโ€™s premium.

Under no circumstances shall the Auction House, its agents, or consignors be liable for incidental, special, or consequential damages, including lost profits or opportunity.

Section 5. Bidder and Consignor Warranties

  • By bidding, the bidder warrants they have read and understood this disclaimer and will not hold the Auction House liable in the event of a successful claim.
  • By consigning property, the consignor warrants clear and marketable title and that the property was not illegally exported or imported in violation of any laws.

Section 6. Indemnification

The consignor agrees to indemnify and hold harmless the Auction House, its agents, and any successful bidder from claims, costs (including legal fees), losses, or damages arising from a breach of these warranties.


4. Hold Harmless and Indemnification

By participating in any auction or transaction on 1800Guns.com, the buyer agrees to hold harmless, defend, and indemnify 1800Guns.com, Michael Williams, Metropolitan Luxury Homes, and all related owners, affiliates, subsidiaries, employees, and assigns in perpetuity against any and all claims, damages, losses, or legal actions arising from:

  • The buyerโ€™s use, misuse, or possession of any purchased item;
  • The buyerโ€™s failure to comply with applicable law;
  • The buyerโ€™s misrepresentation of eligibility or legal status; or
  • Any dispute or liability resulting from the buyerโ€™s actions, negligence, or incompetence.

The buyer acknowledges that determinations of noncompliance or incompetence rest solely with 1800Guns.com, and such determinations are final and binding in perpetuity.


5. Acknowledgment

By placing a bid or completing a purchase on 1800Guns.com, the buyer expressly agrees to all terms set forth above and understands that these terms apply in perpetuity without limitation.

Gift Card Refund Policy Addendum

Effective Date: 22 December 2025

This Addendum is incorporated into and forms part of the 1800Guns.com Terms and Conditions.

By purchasing, receiving, holding, or using a gift card issued by 1800Guns.com, you agree to the following terms:

  1. Refund Eligibility
    Gift cards issued by 1800Guns.com are eligible for a refund. Approved refunds will be issuedย minus a 25% administrative fee, which covers processing and administrative costs.ย 
  2. Refund Requests by Current Holder
    Refunds may be requested by theย current holder of the gift card, regardless of who originally purchased the card. Possession of a valid gift card constitutes sufficient authorization to request a refund.
  3. Refund Method
    Refunds are issued using anย electronic payment method designated by 1800Guns.com not the current holder. Refunds are typically processed withinย 7 business daysย of approval.
  4. Transferability
    Gift cards areย transferable, and refund eligibility follows the gift card itself, not the original purchaser.
  5. Lost or Stolen Cards
    Gift cards should be treated like cash. Lost, stolen, or destroyed gift cards areย not replaceable and not refundable. 1800Guns.com is not responsible for unauthorized use of a gift card.
