Terms & Conditions of Sale – 1800Guns.com

Thank you for choosing 1800Guns.com, a solely owned subsidiary of Michael Williams and M Luxury Homes.
By registering, placing a bid, or making a purchase on 1800Guns.com, you acknowledge and agree to the following terms in full.


1. Returns, Exchanges, Refunds, and Restocking Fee

While all sales are generally final due to the nature of auctions, 1800Guns.com strives to ensure buyer satisfaction and may, at its sole discretion, accept returns under the following conditions:

1.1 Return Window: All returns must be initiated within 25 days from the date of purchase.
1.2 Prior Approval Required: Buyers must obtain prior written approval from 1800Guns.com before returning any item. Returns sent without prior approval will not be accepted.
1.3 Restocking Fee: A 27% restocking fee of the final purchase price (including the buyer’s premium) may apply for approved returns.
1.4 Condition of Returned Items: Items must be returned in the same condition as received, including all original packaging, documentation, and accessories. Items showing damage, wear, or signs of use may incur additional fees or be denied.
1.5 Refund Method: Approved returns will be refunded via the original payment method, minus applicable restocking fees. This refund constitutes the buyer’s sole and exclusive remedy.
1.6 Exceptions: 1800Guns.com reserves the right, at its sole discretion, to deny any return or modify the terms of a return. All decisions are final and binding.


2. Buyer’s Responsibility

It is the sole responsibility of the buyer to know, understand, and comply with all federal, state, and local laws concerning the purchase, transfer, and possession of any item listed on 1800Guns.com — including, but not limited to, firearms, ammunition, accessories, or other restricted items.

  • All restricted items must be transferred to a licensed Federal Firearms License (FFL) dealer within the buyer’s state of residency for final distribution.
  • The buyer must provide a valid copy of their receiving FFL’s license and ensure full compliance with applicable laws.
  • If a buyer is unable to complete a transaction due to legal ineligibility or failure to meet any requirement, no refund or credit will be issued, unless 1800Guns.com chooses to do so at its sole discretion.
  • It is the buyer’s duty to ensure that they are legally eligible to purchase before bidding or buying.

3. Compliance with U.S. and International Law on Cultural Property and Antiquities

Section 1. Preamble: Our Commitment to Ethical Practice

1800Guns.com, operating under Michael Williams and Metropolitan Luxury Homes (hereinafter “the Auction House”), is committed to the ethical and lawful trade of fine art, antiques, antiquities, and other collectible property.
We operate in full compliance with all applicable international, federal, and state laws governing the sale and transfer of cultural property.

This Disclaimer outlines our compliance framework and the obligations of all bidders and consignors.


Section 2. Due Diligence and Provenance

2.1 The Auction House conducts due diligence to verify the provenance and legal status of all lots offered for sale. However, due to the nature of antique and ancient objects, uninterrupted provenance cannot always be guaranteed.
2.2 All statements by the Auction House regarding authorship, attribution, origin, date, age, provenance, and condition are opinions only, not factual representations. All lots are sold “AS IS.”


Section 3. Compliance with International and Domestic Agencies

The Auction House checks relevant lots against international and U.S. databases of stolen, looted, or illegally exported cultural property and cooperates fully with all recognized authorities, including:

International Agencies & Databases:

  • INTERPOL Stolen Works of Art Database
  • The Art Loss Register (ALR)
  • UNESCO (1970 Convention)

U.S. Federal Agencies & Resources:

  • FBI National Stolen Art File (NSAF)
  • U.S. Immigration and Customs Enforcement (HSI) Cultural Property Program
  • U.S. Department of State: Cultural Property Implementation Act (CPIA)

Other Organizations:

  • International Foundation for Art Research (IFAR)
  • International Council of Museums (ICOM) Red Lists

This list is not exhaustive. The Auction House’s compliance extends to any officially recognized cultural heritage protection body.


Section 4. Consequences of a Claim

If any lot is later found or claimed to be stolen, looted, or illegally exported, and that claim is deemed credible by the Auction House or any recognized agency:

a. The lot will be withdrawn or canceled immediately.
b. The Auction House will cooperate fully with the claimant and authorities.
c. The successful bidder must relinquish all rights to the item.
d. The buyer’s sole recourse shall be a full refund of the purchase price (including buyer’s premium).
No additional claim, loss, or damages may be sought against the Auction House or its affiliates.


Section 5. Bidder and Consignor Warranties

5.1 By bidding, the Bidder warrants that they have read, understood, and accepted these terms.
5.2 By consigning property, the Consignor warrants clear title, freedom from liens or claims, and compliance with all applicable import/export laws.


Section 6. Indemnification

The Consignor agrees to indemnify and hold harmless the Auction House, its agents, and the successful Bidder from any and all claims, costs (including legal fees), or damages arising from a breach of these warranties.

This section forms an integral part of the Auction House’s Terms & Conditions and survives the completion of any transaction.


4. Hold Harmless and Indemnification

By participating in any auction or transaction on 1800Guns.com, the Buyer agrees to hold harmless, defend, and indemnify 1800Guns.com, Michael Williams, Metropolitan Luxury Homes, and all related owners, affiliates, employees, and assigns in perpetuity against all claims, damages, losses, or actions arising from:

  • The Buyer’s use, misuse, or possession of any purchased item;
  • The Buyer’s failure to comply with any applicable law;
  • The Buyer’s misrepresentation of eligibility or legal status; or
  • Any dispute resulting from the Buyer’s actions, negligence, or incompetence.

The Buyer acknowledges that any determination of noncompliance or negligence rests solely with 1800Guns.com, and such determination is final and binding in perpetuity.


5. Acknowledgment

By registering, placing a bid, or making a purchase on 1800Guns.com, the Buyer expressly agrees to all terms set forth above and understands that these terms apply in perpetuity without limitation.

We appreciate your cooperation in maintaining a transparent, lawful, and ethical auction environment for all participants.
